Provisional Work Permit (PWP)
This visa is offered to foreigners who hold temporary visitor visas but plan to work in the Philippines while waiting for approval of their employment work application. The PWP visa usually lasts three months from date of issue.
The Department of Labor and Employment (DOLE) must also approve the foreigners right to work while waiting for the visa approval.
- Application Process: Ensure all required information is filled out legibly in English using CAPITAL LETTERS. Accomplish two original copies of the Consolidated General Application Form (CGAF), one for submission with documents and one for the Alien Certificate of Registration Identity Card (ACR I-Card) application.
- Document Submission: Arrange all required documents in the order specified in the Checklist of Documentary Requirements (CDR) within a legal-size folder. All sworn statements or affidavits must be original and notarized.
- Civil Registry Documents: All civil registry documents issued in the Philippines (e.g., Birth Certificate, Marriage Certificate) must be original and issued by the Philippine Statistics Authority (PSA).
- Foreign Documents: Original foreign documents must be authenticated by the Philippine Foreign Service Post (FSP) or the Department of Foreign Affairs (DFA) if issued by a local embassy in the Philippines. Documents in a foreign language must have English translation.
- Authorized Representatives: If filing by a representative, attach a photocopy of the Bureau of Immigration (BI) Accreditation ID Certificate or an original Special Power of Attorney (SPA) for EACH applicant along with a photocopy of the representative’s valid government-issued ID.
- Passport Submission: Submit the original valid passport for scanning, which will be returned afterward. Applicants must bring their original passport and/or valid ID (for Filipinos) for evaluation or interview.
Provisional Work Permit (PWP) – Required Documents:
- Letter-request from the petitioning company to the Commissioner, undertaking to withhold and remit taxes due to the Bureau of Internal Revenue (BIR) on the applicant’s income.
- Duly accomplished CGAF (BI Form CGAF-002-Rev 3).
- Photocopies of applicant’s passport bio-page, entry visa (if applicable), latest admission, and updated temporary visitor’s visa/ valid authorized stay.
- Acknowledged Contract of Service, Employment Contract, Secretary’s Certificate of Election, Appointment, Assignment, Secondment, or Deployment of the applicant, indicating duration of employment, compensation, benefits, and duties.
- Justification for consultant or specialist positions if no Filipino is available and willing to provide the service.
- Board Resolution for corporations or partnerships if signatories differ from those in the Articles of Incorporation and latest General Information Sheet (GIS).
- Photocopy of the official receipt of Alien Employment Permit (AEP) or 9g application.
- Photocopy of applicant’s Taxpayer’s Identification Number (TIN) card or proof of TIN.
- Special Temporary Permit for professions regulated by the Professional Regulation Commission (PRC).
- Bureau of Immigration Clearance Certificate.
Additional Requirements:
- Petitioner’s Income Tax Return (ITR) with proof of payment or filing, or for newly created companies, certificate of registration with the BIR and quarterly tax payments.
- Corporations or Partnerships: SEC Certificate of Registration, Articles of Incorporation, and stamped General Information Sheet (GIS) for the current year.
- Single Proprietorships: Department of Trade and Industry’s Certificate of Registration of Business Name.
- Mayor’s Permit.
